OSHA - ETS: Everything You Need to Know

The new OSHA-ETS is overwhelming. Don’t worry! I’ve compiled some quick facts and tips to help you navigate!

The OSHA-ETS has been in litigation pretty much since its announcement, but you’ll still want to make sure that you are prepared to execute the guidelines in a timely fashion after the court proceedings have finished.

Right now, OSHA has agreed to refrain from issuing citations until after January 10th for all compliance requirements. They will also extend the grace period for testing requirements until February 9th. This extension only applies if you are making an active effort to comply with the standard.

What does that mean? If you haven’t created a plan of execution - start now.

WHO:

Private businesses with 100+ employees

  • This applies to businesses with 100+ employees on or after 11/05/2021

WHAT & WHEN:

  1. Written Vaccination Policy

    You must have a written COVID-19 vaccination policy and make an effort to distribute this policy to all their employees. The due date for this is January 10th

  2. Unvaccinated employees must be masked & PTO requirements for vaccines

    The ETS requires all unvaccinated employees to be masked beginning January 10th. It also requires employers to grant PTO for employees receiving vaccinations or boosters, including time for recovery.

  3. Unvaccinated employees submit to weekly testing

    OSHA has given employers a grace period and will not begin issuing citations for this section of the ETS until February 9th as long as you have made an effort to comply.
